L’Exquisserie specializes in handcrafted French-style pastries, desserts, custom cakes, dessert tables, event services, and selected pastry-related products.
2. Scope of Application
These Terms & Conditions apply to all orders placed through our website, including but not limited to:
• Online pastry orders
• Custom cakes and desserts
• Personalized products
• Dessert tables and event services
• Delivery and pickup services
• Seasonal collections and special releases
By placing an order, the customer confirms that they have read, understood, and accepted these Terms & Conditions in full.
3. Products & Craftsmanship
All products are handcrafted, made to order, or produced in small batches.
As a result:
• Slight variations in appearance, color, size, decoration, or finishing details may occur.
• Such variations are a natural part of artisanal production and do not constitute a defect.
• Product descriptions and photographs are provided for reference only.
4. Allergens & Food Safety
Our kitchen handles common allergens, including but not limited to:
• Milk
• Eggs
• Wheat (Gluten)
• Tree Nuts (including almonds, pistachios, hazelnuts, pecans, walnuts, cashews, Brazil nuts, macadamia nuts, and pine nuts)
• Peanuts
• Soy
• Sesame
• Fish- derived Gelatin
Despite strict hygiene and food safety procedures, cross-contamination may occur.
Customers with allergies or dietary restrictions are responsible for reviewing our Allergens & Food Safety page before placing an order.
By purchasing our products, customers acknowledge and accept this risk.
5. Orders & Payment
All prices are listed in Canadian Dollars (CAD).
Applicable taxes (HST) are added at checkout.
Orders are confirmed only once full payment has been received.
Full payment is required for all standard and custom orders before production begins.
L’Exquisserie reserves the right to refuse, hold, review, or cancel an order in the event of:
• Pricing errors
• Technical issues
• Ingredient unavailability
• Suspected fraud
• Unauthorized or suspicious payment activity
Additional verification may be requested before an order is accepted or fulfilled.
6. Custom Orders & Events
Custom cakes, personalized products, dessert tables, corporate orders, and event services are made specifically for each customer and are considered final sale.
All custom orders require full payment before production begins.
Once payment has been received and the order has been confirmed, custom orders, personalized products, dessert tables, and event services cannot be cancelled, modified, or refunded.
Design approvals, flavor selections, inscriptions, sizing, and other specifications are the responsibility of the customer and must be reviewed carefully before confirmation.
Event-related services may be subject to specific delivery, setup, scheduling, venue, and access conditions.
7. Perishable Products – Final Sale
Due to the perishable nature of our products, all sales are final.
No returns, exchanges, or refunds are accepted once products have been prepared, picked up, or delivered.
This includes orders placed incorrectly by the customer.
Refunds, replacements, or store credits may be considered at L’Exquisserie’s sole discretion.
Orders not collected on the scheduled pickup date may be discarded for food safety reasons. No refund will be provided.
8. Delivery & Pickup
Delivery times are estimates and may be affected by:
• Traffic
• Weather conditions
• Building access restrictions
• Third-party courier services
L’Exquisserie is not responsible for:
• Delays caused by circumstances beyond our reasonable control
• Failed deliveries resulting from incorrect information provided by the customer
• Customer absence at the delivery address
Customers are responsible for providing accurate contact and delivery information.
For pickup orders, responsibility for the product transfers to the customer upon pickup.
For delivered orders, responsibility transfers to the customer upon successful delivery to the address provided.
9. Storage & Consumption
Customers are responsible for:
• Proper storage of products
• Following all storage and consumption instructions provided
• Appropriate transportation and handling after pickup or delivery
For optimal freshness, quality, and food safety, products should be consumed and stored according to the recommendations provided by L’Exquisserie.
L’Exquisserie is not liable for issues resulting from improper storage, handling, transportation, or delayed consumption.
10. Limitation of Liability
To the maximum extent permitted by Ontario and Canadian law:
• L’Exquisserie shall not be liable for indirect, incidental, special, or consequential damages.
• Any liability arising from an order shall be limited to the purchase price paid for the affected product(s).
Nothing in these Terms & Conditions limits liability where such limitation is prohibited by law.
11. Intellectual Property
All content on this website, including but not limited to text, photographs, logos, branding, designs, graphics, product concepts, and visual content, is the exclusive property of L’Exquisserie.
Unauthorized reproduction, distribution, modification, or commercial use is prohibited without prior written consent.
12. Governing Law
These Terms & Conditions are governed by the laws of the Province of Ontario and the applicable laws of Canada.
Any dispute arising from the use of this website or the purchase of products must first be addressed by contacting L’Exquisserie directly.
If a resolution cannot be reached, the dispute shall be subject to the exclusive jurisdiction of the courts of Ontario.
13. Amendments
L’Exquisserie reserves the right to update or modify these Terms & Conditions at any time.
The version in effect at the time an order is placed shall apply.
